Standard version between the carrier and the customer concerning transport services under the Shuttler brand.

Applicable for the following carriers:

1 Scope

1.1 These General Conditions of Carriage (hereinafter GCC) apply to journeys booked via Shuttler GmbH (hereinafter Shuttler) for the carriage of passengers, luggage or goods (transport service).

2 Contractual partners

2.1 The contract of carriage is concluded between the carrier designated during the booking process and the customer upon the customer's receipt of the booking confirmation.

3 Subject of the contract

3.1 The subject of the contract of carriage between the customer and the carrier is the carriage of passengers, luggage or goods from a point of departure to a point of arrival at a specific time in accordance with the booking confirmation.

3.2 Carriage is performed using the carrier's means of transport, as a rule passenger cars. In individual cases, other means of transport may also be used.

4 Fulfilment

4.1 The contract of carriage is deemed fulfilled upon carriage of the booked passenger/luggage/goods from the point of departure stated in the booking confirmation to the stated point of arrival at the stated departure time.

4.2 The contract of carriage is likewise deemed fulfilled upon carriage of the booked passenger/luggage/goods from a point of departure located within a maximum radius of 1000m of the point of departure confirmed in the booking confirmation, to a point of arrival located within a maximum radius of 1000m of the point of arrival confirmed in the booking confirmation.

4.3 The contract of carriage is likewise deemed fulfilled upon reimbursement of the travel costs of an alternative means of transport chosen by the carrier, from the same municipality of origin to the same municipality of destination, within one month of the booked travel date. The details provided by the customer during the booking process are decisive for calculating the travel costs of the alternative means of transport.

5 Performance by the carrier

5.1 The carrier is responsible for proper performance of the service, in particular compliance with all statutory provisions. There is no entitlement to a specific means of transport.

5.2 The performance of the service is subject to the legislation on the professional carriage of passengers, insofar as it constitutes professional carriage of passengers. The carrier may, within the limits of what is legally permissible, also use non-professional carriage of passengers.

6 Representation by Shuttler

6.1 The carrier may be represented by Shuttler in carrying out bookings, cancellations, rebookings and other activities connected with the carriage.

7 Tickets

7.1 Tickets are personal, non-transferable and valid only together with a travel document.

7.2 For the journey, the ticket must be available in electronic or printed form.

8 Cancellation

8.1 The customer may withdraw from the booking up to 6 hours before the journey without giving reasons and, in this case, is reimbursed the fare in the form of a voucher that can be used with Shuttler. The carrier may provide promotional fares that fully exclude rebooking or cancellation. Processing of the cancellation request may take up to 24 hours.

8.2 Rebookings are usually carried out by way of cancellation and rebooking.

8.3 The carrier may charge a reasonable fee for the expenses incurred in connection with rebookings, cancellations, name changes and refunds, which shall not exceed 15 francs per transaction.

9 Payment and fare

9.1 A booking entails the obligation to pay the fare immediately. The fare results from the booking confirmation. For telephone bookings, the carrier may charge an additional fee not exceeding 15 francs per transaction.

9.2 At Shuttler's discretion, a payment period may be granted to the customer and notified in writing. Unless otherwise agreed, payment is due at the latest at the time of the journey. If the fare is unpaid, Shuttler or the carrier may refuse carriage.

9.3 The carrier may charge a fee for reminders, not exceeding 20 francs per reminder run.

9.4 Travellers found in the passenger compartment without a valid ticket must pay a flat-rate carriage charge of 100 francs.

10 Carriage restrictions

10.1 The carrier may refuse to carry the customer or their luggage if one or more of the following conditions is met or, in the carrier's discretion, could be met:

10.2 If the customer is excluded from carriage on the basis of one or more of the aforementioned grounds, the fare is reimbursed only if the customer did not cause the exclusion from carriage themselves.

11 Children

11.1 Children under 8 years of age may travel only when accompanied by a person at least 16 years of age.

11.2 Children between 15 kg in weight and the age of 12, respectively 150 cm in height, are carried on booster seats provided by the carrier, where a child restraint device is required in the vehicle used by the carrier. The accompanying person is free to bring their own child restraint devices.

11.3 Children under 15 kg require special child seats. These must be brought by the accompanying person themselves. Children under 15 kg who do not bring their own child seats cannot be carried.

12 Mobility restrictions

12.1 Unaccompanied children under 8 years of age, persons with disabilities, pregnant persons, sick persons or persons requiring special care can, for safety reasons, be carried only if the carrier has consented to the carriage beforehand, but at least 24 hours before departure.

12.2 If the carriage of a mobility-restricted customer is not possible for technical reasons, the customer is entitled to reimbursement of the fare and assistance in finding alternative travel options.

13 Animals

13.1 Dogs and other animals can be carried only if the carrier has consented to the carriage beforehand.

13.2 Consent must be obtained at the latest 24 hours before departure; the carrier may charge a fee of 15 francs per animal.

14 Luggage

14.1 The carrier carries travel luggage in the luggage compartment free of charge. The carriage of one piece of luggage with a maximum size of 50×30×80 cm and a maximum weight of 20 kg is included in the price.

14.2 The carrier may offer promotional fares with less or smaller luggage.

14.3 The carriage of further pieces of luggage is subject to available capacity and cannot be guaranteed. It is strongly advised to notify Shuttler of the carriage of further pieces of luggage up to 24 hours before departure. The carrier charges a fee of 10 francs per additional piece of luggage.

14.4 Hand luggage is limited to a maximum size of 42×30×18 cm and a maximum weight of 7 kg. The customer is responsible for ensuring that the hand luggage does not endanger other travellers. As a rule, the customer must stow the hand luggage in the passenger compartment and supervise it throughout the journey.

14.5 The carriage of special luggage exceeding the dimensions under point 14.1 (musical instruments, ski, surf or golf equipment as well as bicycles) requires in every case the carrier's consent at the latest 24 hours before departure. Special luggage may not exceed a weight of 35 kg and a maximum size of width+length+depth=240 cm (with a maximum edge length of 190 cm) and must be loaded together with the driver. The carrier may charge a fee of 15 francs per piece of special luggage.

15 Liability

15.1 The carrier is liable for luggage damaged, lost or stolen during the journey only in cases of intent or gross negligence. This liability is limited to 200.- Fr. per customer. Mandatory statutory liability, in particular under the Road Traffic Act (SVG), remains reserved.

15.2 Statutory liability applies to personal injury of passengers. Decisive are in particular the strict liability of the vehicle holder under the SVG and the carrier's compulsory motor third-party liability insurance. No contractual limitation of this liability is made.

15.3 In all other respects, the carrier's liability for property damage or personal injury is excluded as far as legally permissible. Intent, gross negligence and mandatory statutory provisions, in particular Art. 87 SVG, remain reserved.

16 Cancellation or delays

16.1 The carrier provides travel times in advance for the passenger's information. The carrier may deviate from the published travel times.

16.2 If a deviation of more than 120 minutes from the travel times previously published by the carrier – among others via Shuttler – has occurred (departure or arrival time) or is to be expected with high probability, the customer may withdraw from the journey and is entitled to a full refund of the fare.

16.3 If the customer cannot be carried through their own fault, or is not at the agreed stopping point at the stated travel time, there is no entitlement to a refund of the fare.

17 Termination of the contract of carriage

17.1 The carrier may terminate the contract of carriage without giving reasons up to 14 days before the journey. In this case, the customer is entitled to a fee-free refund of the fare.

17.2 The carrier may terminate the contract of carriage at any time where good cause exists. If termination occurs later than 14 days before the start of the journey, the customer is entitled to a fee-free refund of the fare and compensation of 50% of the fare.

17.3 If termination occurs less than 6 hours before departure, the customer is entitled, at their option, to a refund of the fare and compensation of 50% of the fare, or to a comparable alternative carriage.

17.4 The customer may terminate the contract of carriage at the latest 6 hours before departure without giving reasons. The carrier may limit the refund of the fare to a credit voucher usable with Shuttler within one year. The carrier may deduct a fee of 10.- for the refund.

17.5 The carrier may terminate the contract with the customer at any time, provided it is ensured that the customer can conclude a contract of carriage with another carrier offered on Shuttler that can guarantee an equivalent carriage within the meaning of point 4 at the agreed travel times (+/- 60 minutes).

18 Customer's obligations

18.1 The customer must follow the instructions of the driving personnel.

18.2 The customer is not permitted to smoke conventional or electronic cigarettes in the vehicle.

18.3 The customer is liable for damage they cause to the vehicle. In the event of soiling caused negligently or intentionally by the customer, the carrier charges the customer a cleaning flat rate of at least 150.- Fr.

18.4 The customer must wear seat belts during the journey, where the vehicle is equipped with them.

18.5 The driving personnel may prohibit the consumption of alcoholic beverages. Consuming drugs in the vehicle is not permitted.

18.6 The customer undertakes to use the internet connection exclusively in a manner compliant with the law and the contract.

18.7 The use of power sockets is at the customer's own risk. The carrier expressly points out that the use of the power sockets is at one's own risk. The carrier declines any liability for any damage arising from the use of the power sockets.

19 Data protection

19.1 The carrier undertakes to observe Swiss data protection laws when handling the customer's data.

19.2 The customer's data is used for the following purposes: maintenance and improvement of customer relationships, quality assurance, increasing operational safety, in the interest of sales promotion, product design, crime prevention, containment of epidemics, investigation of accidents and crimes, statistics and invoicing.

19.3 The customer acknowledges that the carrier is entitled to pass on the data to the carrier to the extent necessary for the provision of the specific service (contract of carriage including additional services and fees). Beyond this, the carrier does not pass on any of the customer's data to third parties without their consent. The legally required disclosure of data, in particular to law enforcement authorities for the investigation of crimes, remains reserved.

20 Transfers

20.1 If the customer books a connecting service via Shuttler and its connections are not guaranteed, the customer is entitled to carriage on the next possible connection.

20.2 If, due to a missed connection, rebooking is not possible and, as a result, a deviation of the arrival time from the originally published travel times of at least 120 minutes is to be expected, the customer may withdraw from the journey and is entitled to a refund of the fare.

21 Applicable law

21.1 Swiss law applies. With regard to the transport service, the provisions on the mandate (Art. 394 ff. CO) apply. For disputes between the customer and the carrier, the place of jurisdiction is the carrier's registered office; insofar as the registered office is not located in Switzerland, Zurich. Should individual provisions of the Swiss legal order at the time of the conclusion of the contract contradict these GCC, this does not affect the validity of the GCC in other respects.

21.2 For transport services performed on the basis of a concession or authorisation under the Swiss Passenger Transport Act, the corresponding legal norms apply and take precedence over these GCC where mandatory. Should individual provisions of these GCC thereby become ineffective or void, this does not affect the validity of the GCC in other respects.

21.3 For transport services performed on the basis of an authorisation under Regulation (EC) No 1073/2009 of the European Parliament and of the Council, the corresponding legal norms apply and take precedence over these GCC where mandatory.
